Le contrat de location doit être établi par écrit :
lorsqu'il s'applique à  des locaux vides (c'est-à -dire non meublés) à  usage d' habitation principale ou à  usage mixte professionnel et d'habitation principale du locataire, ainsi qu'aux garages, places de stationnement, jardins et autres locaux, loués accessoirement au local principal par le même bailleur ;
lorsqu'il porte sur la location d'un local affecté à  un usage exclusivement professionnel ;
lorsqu'il concerne un logement meublé et que ce logement constitue la résidence principale du locataire.
Les parties sont libres de conclure le bail :
soit sous seing privé (il convient alors d'établir autant d'originaux qu'il y a de parties ayant un intérêt distinct au contrat) ;
soit par acte notarié (expédié alors à  chaque partie).
Enfin, sachez que lorsque le bail a une durée supérieure à  douze ans, il doit être dressé en la forme authentique : celle-ci est obligatoire pour la publication au bureau des hypothèques du lieu de situation de l'immeuble.
Dans tous les cas, il y a des obligations de diagnostics techniques immobiliers, (DTA, performance énergétique, plomb,etc...)
